1. Acceptance of Terms & Capacity
By accessing and using the Amy's Bakes website and our digital baking academy, you agree to be legally bound by these terms and conditions of use and sale. You must be at least 18 years old, or have the consent of a parent or legal guardian, to make a purchase. By providing your email address and completing online transactions, you consent to receive communications, receipts, and documents electronically. If you do not accept these terms, you should not use the platform.
2. Who We Are
Amy's Bakes is operated by Amys Bakes LLC, a limited liability company located at 21110 Waze Lewis Dr, New Caney, TX 77357, USA ("we", "us", or "the Company"). You can reach us at academia@amysbakes.com.
3. Intellectual Property & Digital Courses
Courses purchased through the platform are for personal, revocable, and non-transferable access. Copying, distribution, screen recording, account sharing, or reselling of audiovisual materials, recipes, or downloadable resources from Amy's Bakes is strictly prohibited.
4. Info-products Refund Policy
Due to the digital and immediate nature of online courses and info-products, we do not offer refunds or cancellations once the charge has been processed by Stripe and access to the student dashboard is granted. All course sales are final.
5. Custom Cakes, Allergens & Quoting Terms
Submitting the custom cake form is purely for informational and quoting purposes. No physical order is considered scheduled or guaranteed until our team confirms viability, validates the date, and receives the payment of the agreed deposit. Our products are made in a shared kitchen space that handles gluten, dairy, eggs, tree nuts, soy, and other common allergens; while we accommodate special ingredient requests, we cannot guarantee the total absence of cross-contamination. It is the customer's responsibility to disclose any allergy or dietary restriction in writing when requesting a quote; Amy's Bakes is not liable for allergic reactions arising from allergies not previously disclosed.
6. Shipping & Damaged Physical Products
Cakes and baked goods shipped via carrier (including shipments handled through UPS) are perishable goods. The customer must inspect the product upon delivery and report any damage, order error, or defect within 24 hours of delivery, attaching photographic evidence to academia@amysbakes.com. Due to their perishable nature, physical returns of the product are not accepted; however, we will consider replacements or partial refunds when the damage is attributable to shipping or an error on our part. We are not responsible for delays caused by the carrier, weather conditions, or incorrect delivery addresses provided by the customer.
Physical order refunds: refunds are requested and handled exclusively through a ticket to our support team (academia@amysbakes.com or the "Contact support" button); there is no self-service refund button. The cost of products and shipping is only refunded on orders that have NOT yet been dispatched. Once the label has been scanned by the carrier and the order is in transit, no refunds of the order or shipping are issued, without prejudice to the damage-replacement evaluation described above.
7. User Conduct, Chat & Reviews
By using the classroom chat or posting a review, you agree not to post offensive, defamatory, or spam content, or content that infringes the rights of third parties. We reserve the right to remove any message or review, and to suspend or terminate the access of any user who violates this rule, at our sole discretion.
8. Limitation of Liability & Disclaimer of Warranties
To the maximum extent permitted by law, Amys Bakes LLC will not be liable for indirect, incidental, special, or consequential damages arising from your use of the platform, courses, or purchased products. Our total liability to you for any claim will not exceed the amount actually paid for the order or course in question. The platform and its content are provided "as is", without warranties of any kind except those that applicable law does not allow us to exclude.
9. Copyright Notice (DMCA)
We respect the intellectual property rights of others. If you believe content posted on the platform (for example, in the classroom chat or in reviews) infringes your copyright, you may send a notice to academia@amysbakes.com including: (i) identification of the protected work; (ii) identification of the allegedly infringing content and its location; (iii) your contact information; and (iv) a good-faith statement that the use is not authorized by the rights holder. We do not currently have a DMCA agent registered with the US Copyright Office; we will address notices received in good faith through the email above.
10. Governing Law, Jurisdiction & Arbitration
These terms will be governed by and construed in accordance with the laws of the State of Texas, USA, without regard to its conflict-of-laws provisions. Any dispute, controversy, or claim arising out of or relating to these terms, the platform, or any product or course purchased will be resolved through binding, individual arbitration rather than a lawsuit in court, except for claims that may be brought in small-claims court. You and Amys Bakes LLC waive any right to participate in a class or representative action. Arbitration will take place in the county where the Company is located, unless the parties agree otherwise.
11. General Provisions
If any provision of these terms is found invalid or unenforceable, the remaining provisions will continue in full force. These terms constitute the entire agreement between you and Amys Bakes LLC regarding use of the platform. We may update these terms periodically; changes take effect once posted on this page with a revised update date, and continued use of the platform after posting constitutes your acceptance of the modified terms.
